1. Introduction
LumynX is a technology and AI automation company providing software-based solutions through its proprietary AI systems and integrations with third-party platforms.
These Terms and Conditions govern the use of LumynX services. By purchasing or using any LumynX service, the client agrees to these Terms, including future updates.
A copy of these Terms, along with plan details, will be sent to the email address provided at checkout. This document constitutes proof of acceptance and formalization of the agreement.
Disclaimer: No telemarketing or cold-calling. We only engage inbound opt-ins and existing customers.
2. Terms of Service
Software Access
Clients receive access to a LumynX account, which may operate as a sub-account within licensed third-party platforms used by LumynX. Access includes features designed to optimize business communication and automation.
Training & Academy Access
Clients may receive access to LumynX training resources. While recommended, use of training materials is optional and does not guarantee results.
Permitted & Prohibited Use
Any use that violates applicable laws, infringes data privacy, disrupts system stability, or attempts unauthorized access is strictly prohibited. Use of the Services for telemarketing, cold-calling, or contacting purchased lists is strictly prohibited.
Client Responsibility
LumynX provides the tools and resources necessary to use the Services. Proper implementation and management are the sole responsibility of the client. Failure to use the system effectively does not constitute grounds for refunds or disputes.
Account Data & Billing Updates
Clients are responsible for keeping billing and contact information up to date. LumynX is not liable for charges resulting from outdated information.
3. Intellectual Property & Content
All software, training materials, documentation, and proprietary systems provided by LumynX remain the exclusive property of LumynX.
Clients may not copy, redistribute, sublicense, or reproduce any materials without written authorization.
Use of third-party platforms does not grant ownership of those platforms or their intellectual property.
4. Cancellation & Refund Policy
Subscription Cancellation
Clients may cancel their subscription prior to the next billing cycle through their LumynX account or by contacting [email protected]
Refund Policy
No refunds are issued once the client has accessed software features or training materials after purchase or trial expiration.
Refund exceptions may be considered only if access was not provided or cancellation attempts were properly documented.
Annual Plans
Annual plans are billed upfront at a discounted rate. Cancellation does not terminate access until the paid term expires.
No Refunds on Annual Plans
Annual plans are non-refundable, even if canceled shortly after purchase.
5. Privacy Policy – Data Collection & Processing
Clients manage their own databases within LumynX. LumynX stores only the data necessary to deliver services.
Upon cancellation, clients may export their data. LumynX will then delete associated data within a reasonable timeframe.
Clients are responsible for obtaining lawful consent from their end users.
6. Limitation of Liability
LumynX is not responsible for service interruptions or failures caused by third-party providers, including but not limited to hosting, AI APIs, payment processors, or telephony services.
To the maximum extent permitted by law, LumynX shall not be liable for indirect, incidental, or consequential damages.
7. Modifications to the Terms
LumynX reserves the right to modify these Terms. Updates will be communicated at least 7 days in advance via the registered email address.
Continued use of the Services constitutes acceptance of the updated Terms.
8. No Warranty Disclaimer
LumynX makes no guarantees regarding specific results, revenue, conversions, or business outcomes. Performance depends on multiple external factors beyond LumynX’s control.
9. Uniformity of Terms
All LumynX plans—monthly, annual, agency, or white-label—are governed by these same Terms unless explicitly stated otherwise in writing.
10. Support
Standard Plans
Support is available within the platform. Response times are estimated between 15–30 minutes but are not guaranteed.
Agency Plans
Support is provided through LumynX training resources and community channels.
Support does not guarantee immediate resolution or specific results.
11. Additional Costs
Call Usage Fees
Per call: $0.02
Per minute of AI voice usage: $0.19
Third-Party Charges
Clients are responsible for costs from external providers (e.g., Twilio, IP calling services). These fees are not included in LumynX subscriptions.
Inbound-only usage: Call/voice fees apply to inbound calls and to contacting existing customers or inbound opt-ins only. No cold-calling or purchased lists are permitted.
12. Payment Method Registration & Account Activation
A valid payment method is required during onboarding.
Failure to complete onboarding or maintain valid payment information may result in account suspension.
LumynX reserves the right to deactivate accounts with incomplete payment setup.
13. Custom Installations
Development Start
The development period begins once all required documentation is received.
Timeline Extensions
Development timelines may be extended up to 10 business days if required to ensure quality delivery.
Post-Delivery Modifications
Any changes requested after delivery are not included and will be billed separately.
Billing Structure
Custom installation fees are billed upfront. Subscription billing begins only after project delivery.
14. Partner Reseller Program
Partners may promote LumynX using assigned affiliate links and earn commissions.
Commission details, trials, cancellations, and payouts are available in the partner dashboard.
Payments are issued monthly via PayPal. Commission structures may change with notice.
Partners must maintain an active LumynX plan and promote the product ethically.
LumynX reserves the right to revoke commissions in cases of fraud, misrepresentation, or brand damage.
15. Trial Plans
Trial Activation
Trials begin immediately upon subscription activation.
Onboarding Requirement
Onboarding is required to fully enable advanced features.
No Trial Extensions
Trials cannot be extended.
Billing After Trial
Billing begins automatically at the end of the trial period regardless of onboarding completion, unless canceled beforehand.
16. Onboarding Call
All LumynX plans require onboarding.
Subscriptions activate immediately upon purchase, independent of onboarding completion.
Training materials are available prior to onboarding and recommended for preparation.
